Last updated: October 20, 2026
These Terms of Service ("Terms") govern your access to and use of the products and services provided by Ambysto Technologies LLC ("Ambysto", "we", "us"), a limited liability company organized under the laws of Wyoming, United States, with its registered office at 1021 E Lincolnway #10890, Cheyenne, WY 82001. Our products include Distraction Foundry (distractionfoundry.com) and DigiSkill (digiskill.ai) (each a "Service"). By subscribing to or using a Service, you agree to these Terms.
1. Who may use the Services
You must be at least 18 years old and able to form a binding contract. If you use a Service on behalf of a company or other organization, you confirm that you are authorized to accept these Terms on its behalf.
2. The Services
Distraction Foundry is a managed content service. Based on the package you choose, we produce social and website content from the brand information and materials you provide, deliver it through our content workspace, support scheduling and publishing, and provide monthly reporting.
DigiSkill is a software-as-a-service platform that lets you create and operate online communities and courses, manage members, host events and accept payments from your own members. DigiSkill is available on Enterprise plans only.
The features included in each plan or package are described on the relevant product website at the time of purchase.
3. Accounts
You are responsible for the accuracy of the information in your account, for keeping your login credentials secure, and for all activity under your account. Notify us promptly at [email protected] if you suspect unauthorized use.
4. Subscriptions, fees and payment
- Services are sold as subscriptions billed in advance on a monthly or annual basis, at the prices shown on the product website or in your order.
- Prices are in US dollars and exclude any applicable taxes, which are added where required.
- Subscriptions renew automatically at the end of each billing period until cancelled. You authorize us and our payment processor to charge your payment method on each renewal.
- If a payment fails, we may retry the charge and may suspend the Service until the balance is paid.
- We will give at least 30 days' notice before changing the price of an existing subscription. The new price applies from your next renewal.
5. Cancellation and refunds
You can cancel at any time. Cancellation takes effect at the end of the current billing period. Refunds are handled under our Refund & Cancellation Policy, which forms part of these Terms.
6. Your content
You keep all rights to the content, brand materials and data you provide or upload ("Your Content"). You grant us a limited license to use Your Content only to provide and improve the Service for you. You confirm you have the rights needed to share Your Content with us.
For Distraction Foundry, once you have paid for the applicable billing period, you own the content assets we deliver to you for that period and may use them without restriction. Our templates, tools, workflows and software remain our property.
7. Communities and payments on DigiSkill
If you use DigiSkill to sell memberships or courses to your own members, you are the seller to those members. You are responsible for your offering, your pricing, your refund terms to your members, and compliance with laws that apply to you. Payments from your members are processed by our third-party payment provider under its own terms.
8. Acceptable use
You may not use any Service to:
- break any law or infringe anyone's intellectual property, privacy or other rights;
- publish or sell content that is illegal, fraudulent, hateful, sexually explicit, or that promotes violence or self-harm;
- send spam or run deceptive schemes, including get-rich-quick or pyramid schemes;
- upload malware or attempt to disrupt, probe or gain unauthorized access to our systems;
- resell or sublicense the Service without our written permission.
We may suspend or remove content or accounts that breach this section.
9. Availability and changes
We work to keep the Services available and reliable but do not guarantee uninterrupted operation. We may update or improve features over time. If we remove a material feature you pay for, you may cancel and receive a pro-rated refund for the unused part of a prepaid period.
10. Disclaimers
Except as expressly stated in these Terms, the Services are provided "as is" and "as available". We do not guarantee specific results, such as follower growth, engagement, revenue or sales.
11. Limitation of liability
To the maximum extent permitted by law, Ambysto will not be liable for any indirect, incidental, special or consequential damages, or for lost profits or data. Our total liability for any claim relating to the Services is limited to the amount you paid us in the 12 months before the event giving rise to the claim.
